Colorado’s Roofing Contract Law & What It Means for You
Colorado Senate Bill 38, codified at C.R.S. 6-22-101 through 6-22-105, governs residential roofing contracts of $1,000 or more paid from a property insurance claim. Two provisions are worth knowing before you sign anything.
The deductible-waiver prohibition. A roofing contractor can’t advertise, promise, or agree to pay, waive, or rebate any part of your insurance deductible. If a contractor makes that offer, your insurer isn’t obligated to consider that contractor’s repair estimate. That promise is a red flag, not a benefit.
Public adjuster restrictions. A public adjuster is a licensed professional who negotiates insurance claims on behalf of policyholders, typically for a percentage of the final settlement. Colorado law prohibits a roofing contractor from acting as a public adjuster unless they hold a separate license from the Colorado Division of Insurance. That said, a contractor with a signed contract may still discuss the scope of repairs with your insurer on your behalf. You don’t need a public adjuster to file a roofing claim, and hiring one is your choice.
